TERMS AND CONDITIONS

SECTION 3: MW LIFT SERVICES LIMITED, TERMS & CONDITIONS OF SALE – (T’S & C’S). FOR MAJOR & MINOR REPAIRS, LIFT REFURBISHMENTS AND NEW LIFT INSTALLATIONS. 

1. General

MW Lift Services Ltd offer various services to the lift industry which include (but not limited to); maintenance, repairs, installation of passenger, goods lifts and service lifts within the UK and Ireland only. All works carried out are by trained and competent Lift Engineers familiar with the equipment they are working on.

All orders, acceptance of work in any such way (emails, phone calls or official acceptance) will be subject to our T’s & C’s. No other conditions will apply unless previously stated in written to us before we issue quote acceptance form.

2. Prices

All prices for works are subjected to Value Added Tax (VAT) at the current rate upon the day stated in this document. VAT Exemption will only be allowed upon completion of a VAT Exempt Declaration. All prices stated within any quote from MW Lift Services Ltd are subjected to a 30-day term, beyond that point the quote maybe subjected to prices increases. Consideration must be made to payment terms stated within this document. 

3. Cancellation

Cancellation of orders may not be cancelled once accepted by MW Lift Services Limited for any reason without our written agreement.

At MW Lift Services Ltd discretion, cancellation of orders for works may only be cancelled subject to the Purchaser’s agreement to pay an amount equivalent to MW Lift Services Ltd costs incurred. Cancellation of orders for equipment which is already in production will not be considered under any circumstance and will be subject to additional fees.

4. Specification

Any works and/or parts supplied by MW Lift Services Ltd is on condition that the Purchaser is satisfied that the goods are suitable for their purpose. All new installations will require to be pre-approved by the customer. Any change, alteration or mistake made by the customer will be at the Customer / Purchasers cost and MW Lift Services Ltd will not be held liable, in any such way, for this. Additional fees, labor costs and equipment needed will be charged at an additional rate to that on the quotation form. All drawings are required to be signed by Customer / Purchaser prior to commitment to order.

 5. Delivery

Deliveries of parts will only be made to addresses in the UK and Ireland. All delivery charges are based upon 9am – 4pm, any out of hours deliveries will incur additional charges. All deliveries to the Customer / Purchasers address will require their signature after a complete and thorough check of packaging and parts, it is the customers / purchasers’ responsibility to open any package and check its contents. MW Lift Services Ltd accepts no responsibility for any damage to parts / equipment after acceptance of delivery. Any damage part must be refused and MW Lift Services Ltd must be informed immediately within 24-hours. Any non-arrival of goods must be notified to MW Lift Services Ltd within 48-hours.

For new passenger / goods lifts, service lifts or any other multiple packaged equipment delivered to site must be off-loaded by the customer / purchaser. MW Lift Services Ltd does not quote for removal of goods from transportation onto site. This must be carried out by the customer / purchaser. Should this not be possible it is the customer / purchasers responsibility to inform MW Lift Services Ltd of this prior to us issuing the quotation form. It is the responsibility of the customer / purchaser to environmentally remove any redundant materials/packaging.

6. Payment

All payments, unless otherwise stated, are on a 30-day prior after completion of works. Late invoices maybe subjected to further penalties after 60 days. This will be at a rate of £20 per day. For major refurbishments or installations all terms of payment will be detailed within the quote provided. Delay in payment may delay the project and incur additional costs/fees.

On all quotes whereby payment is required up-front, parts will not be ordered until full balance has cleared into our account.

7. Warranty

All parts installed by MW Lift Services Ltd carry a 12 months warranty. For orders for parts only, MW Lift Services Ltd will only apply if installed by a fully qualified lift engineer and serviced at reasonable intervals by a fully qualified lift engineer.

8. Force Majeure

If MW Lift Services Limited is unable to fulfil any of its obligations caused by an event outside of its reasonable control (hereinafter: “Force Majeure Event”), the performance of the Contract is deemed to be suspended for the period that the Force Majeure Event continues. A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control, either foreseeable or not during the conclusion of the Contract, and includes in particular (without limitation) the following: strikes, lock-outs or other industrial action (at the suppliers of Staples); civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; impossibility of the use of public or private telecommunications networks; the acts, decrees, legislation, regulations or restrictions of any government.

When a Force Majeure Event lasts longer than two (2) months, both parties shall have the right to (partially) dissolve the Contract, without incurring any liability for damages.

9. Drawing & Design,

We can only commence the production of drawings upon receipt of a Letter of Intent or an official order. Drawings are prepared from information received from the Purchaser. We do not accept responsibility of liability for errors or discrepancies arising as a result of erroneous or lack of information received from the purchaser before, during or after preparation. We do not accept liability for design in the full sense of CDM requirements. However, we do accept responsibility for ensuring the design of the product, which we procure from our preferred suppliers, meet the Purchaser’s Specification.

9. Storage, Protection, Insurance & Title of Goods

MW Lift Services Ltd reserve the right to charge costs associated with any delay through no fault of ourselves, such as for storage materials (location and size dependant) or non-productive visits to site (£650.00). Should your program be delayed, you must contact us as soon as possible to minimize any impact on program and costs. If we are delayed and lift is placed into storage on site, the responsibility for protection and insurance of the goods passes to the purchaser. Title of the goods will remain with MW Lift Services Ltd until we are paid in full. This will include, but not limited to, any additional costs for labour, parts and labour, additional site visits.

10. Installation

Where it has been agreed by the customer / purchaser and MW Lift Services Ltd to have labour attend to install any part, equipment or part/full lift package on a specific date, should there be delays to carrying out such works beyond MW Lift Services control then a day work charge will be applied at a rate of £650.00 per day. This clause relates to, but not limited to, no or incorrect permanent power supply, unsafe site conditions, condition of shaft structure being incomplete, incorrect or of inadequate construction.

11. Commissioning

Commissioning cannot commence until the Purchaser has confirmed in writing the site is ready for commissioning to commence. This includes a permanent power supply. Should we arrange sufficient labour, and any other testing equipment – such as weights, to site and find the site is not ready for commissioning in any way then a return visit will be needed. This will be charged at an additional rate of £650.00 and all costs suffered by MW Lift Services Ltd for testing equipment will be added as necessary.

12. Aborted Visits

The customer will be liable to pay for any parts or site attendance should they cancel, delay or abort our visit (this includes visits that are currently being attended too). The cost of which will be determined by the particular works, parts and geographical location of site.

13. Miscellaneous

We always ask for Section 2 to be completed by the Purchaser and returned to us for all our quotations. On the occasion where this is not carried out by the Purchaser then payment of any invoice relating to the necessary quotation will be accepted by MW Lift Services Ltd as the Purchaser has read, understood and accepted the quote / T’s & C’s relating to it.

Should any invoice relating to this quotation become 120 days’ overdue, MW Lift Services Ltd reserve the right to attend site and remove equipment to the value of that overdue, including any interest. Until full cleared funds are received the Purchaser must not instruct any other lift company to attend to work on property belonging to MW Lift Services Ltd. Additional fees will become applicable should this become the case. MW Lift Services Ltd reserve the right to attend site and isolate the equipment after any invoice exceeds the 120 days. Under these circumstances a lock and tag out kit will be placed on necessary incoming power supply.

Any parts returned as faulty within the warranty period will be tested by MW Lift Services Ltd or original manufacturer. Should the parts be found to have a manufacturing fault, a replacement will be dispatched within 2 working days. Should the part be found to have been damaged due to improper use or care or found to be not faulty, then it will be returned to the Purchaser and the Purchaser will be invoiced for the cost of testing. If a warranty claim is made and the Purchaser requires an immediate replacement part, then a Purchase Order will be required. A replacement part will be dispatched by MW Lift Services Ltd and an invoice issued. Following testing of the faulty part, should the part be found to have a manufacturing fault, a credit note will be raised against the invoice. This warranty shall only apply if, where applicable, the spare part has been serviced by a fully qualified person. MW Lift Services Ltd’ liability under this clause constitutes its sole liability (save in respect of death or personal injury caused by negligence of MW Lift Services Ltd) whether in contract, tort (including negligence) or otherwise in respect of any defects in the goods supplied under the Sales of Goods Act 1979.
